Terms of Use
Effective October 18, 2026
These Terms of Use ("Terms") are an agreement between Day to Data Inc. ("we", "us") and the business that creates an account ("you", "your company"). By ticking the box when you create an account, or by using SmallBizServices (the "Service"), you agree to these Terms, the Privacy Policy and the Data Retention Policy.
1. The Service
SmallBizServices is a web application that helps small labor-services companies manage clients, properties, jobs, estimates, work orders, invoices and payments records. It is a record-keeping and document tool. It does not process payments between you and your clients, and it does not give legal, tax or accounting advice. Estimates, invoices and other documents are yours, and you are responsible for their content.
2. Eligibility and accounts
- You must be at least 18 and authorized to bind the company that signs up.
- The person who creates the account is the company's Owner. The Owner is responsible for everything done under the company's account, for adding and removing users, and for keeping sign-in details secret.
- You must give accurate sign-up information, including a working email address and phone number, and keep it current.
- One person may belong to one company account.
3. Your data
You own the data you enter, including information about your clients, their properties and your documents ("Customer Data"). You give us permission to store, process and display it only to run the Service for you, as described in the Privacy Policy.
You are responsible for your Customer Data. You promise that you have the right to enter it, that you have told your clients what you do with their information where the law requires it, and that it follows our Data Retention Policy.
Do not enter card numbers, bank account or login details, government identification numbers (such as Social Security numbers), health information, or any information about children. The Service is not built to protect that kind of data.
4. Access by the platform owner
Day to Data Inc. can view the data of every company on the platform. We use this access only to operate and secure the Service, give support, handle billing, prevent abuse, and produce combined or aggregate statistics about use of the Service. Views of company data by our staff are recorded in an audit log. We do not sell your Customer Data.
5. Acceptable use
You will not:
- use the Service for anything unlawful, fraudulent or misleading;
- try to access another company's data, or probe, disrupt or overload the Service;
- upload malware or content you do not have the right to share;
- resell the Service or share one account among several companies;
- reverse engineer the Service, except where the law allows it.
6. Fees, cancellation and refunds
The Service is a subscription charged per company, offered as a monthly plan at $50.00 per month and a yearly plan at $550.00 per year ($50.00 less than twelve monthly payments). These are the prices today; the price that applies to you is the one shown at checkout when you subscribe. There is no free trial. You pay through our payment provider, Stripe, when you create your account; the account opens once you have paid and confirmed your email. Fees are charged in advance, renew automatically each month or year until you cancel, and exclude taxes, which you pay where they apply. Card details are handled only by Stripe and never stored by us.
You can cancel at any time from the billing page. Cancellation takes effect immediately: the account is closed at once, even if you have paid for a longer period. We do not automatically refund any part of a payment, including unused time. If you think a refund is warranted, write to info@smallbizservices.us; we may refund part of a payment at our discretion. After cancellation, your data is handled as described in the Data Retention Policy.
If a payment fails, our payment provider tries again on its own schedule and we tell you. While it does, the account stays open with a notice. If the subscription ends because the payment could not be collected, the account is locked until you subscribe again; its data is kept as described in the Data Retention Policy.
We may change our prices. A new price applies to new subscriptions when we publish it. If we change the price of an existing subscription, we will tell the Owner at least 30 days before the new price applies, and you may cancel before then.
7. Availability and changes
We work to keep the Service available but do not promise it will be uninterrupted or error-free. We may update, add or remove features. If we remove a feature you rely on, we will give notice where we reasonably can. Keep your own copies of anything critical, and use the export described in the Data Retention Policy.
8. Suspension and termination
You can cancel at any time, and cancelling takes effect immediately. We may suspend or end an account for non-payment, breach of these Terms, risk to the Service or other users, or if the law requires. While an account is suspended, its data is kept and not deleted, but nobody in the company can use it. When an account ends, what happens to the data is described in the Data Retention Policy.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. Calculations and reports are aids; check them before you rely on them.
Automatic translation. The Service can translate text between English and Spanish using a third-party provider (see the Privacy Policy). Translations are produced by software and can contain errors or miss nuance. The text as it was first written is the original, and if the two versions differ, the original controls; a translation is a convenience. You are responsible for checking translations before they reach a client, including on estimates and invoices, and you can correct any translation in the Service. We are not responsible for a loss that comes from a translation being inaccurate.
10. Limit of liability
To the fullest extent the law allows, Day to Data Inc. is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the event that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
11. Your responsibility to us
You will cover the losses, costs and reasonable legal fees we incur from a third-party claim caused by your Customer Data or by your breach of these Terms or the law.
12. Changes to these Terms
We may change these Terms. We will post the new version here with its effective date and, for material changes, notify the Owner by email or in the Service. If you keep using the Service after the effective date, the new Terms apply. If you do not agree, cancel before then.
13. Governing law and disputes
These Terms are governed by the laws of the state in which Day to Data Inc. is organized, without regard to conflict-of-law rules. Courts located there have exclusive jurisdiction over disputes, and you and we consent to them. Please contact us first at info@smallbizservices.us so we can try to resolve a problem informally.
14. General
These Terms, with the Privacy Policy and the Data Retention Policy, are the whole agreement between us about the Service. If a part is found unenforceable, the rest stays in force. Not enforcing a right is not giving it up. You may not transfer your rights without our consent; we may transfer ours with a sale or reorganization of our business.
